INSURED PORTAL

This document sets out General Terms and Conditions (hereinafter the “Terms and Conditions”) that regulate access and use of the Insured Portal.

Access to the Insured Portal and its use are subject to acceptance and compliance with these Terms and Conditions so users must abstain from accessing and using the services offered by the Insured Portal if they disagree with them. The Terms and Conditions available at any time on the Insured Portal will be considered current and therefore applicable.

We advise users to print or keep a copy of these Terms and Conditions for future reference, although they will always be available on the Insured Portal.

LEGAL INFORMATION

Conditions of Access

To access, the user (Policyholder, Insured and/or Beneficiary of the Insurance) must enter the identifier and password associated to their access. These access codes are PERSONAL and NON-TRANSFERABLE, with the registered user being responsible for their safe keeping.

The user undertakes to make good use of this website, good use being understood to mean use that is in accordance with current legislation, good faith and public order.

The user undertakes not to use the Insured Portal for fraudulent purposes, as well as not to perform any act with the aim of damaging, rendering useless or overloading the same, or preventing the normal use and function of the same in a any way.

The user is hereby informed that, in the case of non-compliance with the Conditions of Use, the Privacy Policy or other terms and conditions established for the Insured Portal, Agrupación Sanitaria Seguros S.A. reserves the right to limit, suspend or block their access to it, by any technical means it deems necessary to achieve this.

Intellectual and Industrial Property

The Insured Portal design and source code, as well as logos, trademarks and other distinctive signs that appear on it belong to Agrupación Sanitaria Seguros S.A. and are protected by the corresponding intellectual and industrial property rights.

The user is not authorised to decompile, disassemble, reverse engineer, decrypt or otherwise modify the Insured Portal and/or its source code.

Through these Conditions of Use, we grant the user a non-exclusive, non-transferable license for a worldwide geographic scope and for a period of duration established in these Conditions of Use, to access and use the Insured Portal, for the sole purpose of supplying them with our services.

Unless expressly stated otherwise, any use of the Insured Portal other than the one stated above will require prior authorisation from us. In particular, but without limitation, the user will require our prior authorisation to:

Agrupación Sanitaria Seguros S.A. does not guarantee correct functioning in terms of the availability and continuity of the Insured Portal. As far as possible, we will try to inform users of any interruption to the service and rectify the break as soon as possible. However, we are exempt from any liability arising from incorrect functioning or interruptions to the Insured Portal.

Jurisdiction

These Conditions will be governed and interpreted in accordance with Spanish legislation. The user, by the sole fact of accessing the Insured Portal irrevocably gives their consent for the competent court by default to hear from any other legal action derived from or related to these Conditions, or with their use of the Insured Portal or the browsing thereof.

If any clause or section of these Conditions that is not essential for its existence is declared null or unenforceable, the validity of the remaining clauses will not be affected.

Who can provide us with data?

User access to the Insured Portal is only for policyholders, insured and beneficiaries of insurance contracted with Agrupación Sanitaria Seguros S.A.

Certain functions are limited in relation to the status of policyholder, insured and beneficiary of the insurance product contracted.

What data do we collect?

As a result of your registration on the Insured Portal and the use of it, certain personal data owned by you, including your name and surname, email, ID number or Spanish Foreigner’s Identificacion number, policy number or your date of birth will be processed to give you access as a registered user of the Insured Portal. All the data requested at the time of registering as a user of the service are mandatory, failure to provide any of this data may prevent you registering for the service and render you unable to access its functions.

Once the data requested has been handled, an email will be sent to the address provided for identity verification and authentication, to check the accuracy of the address and process the user’s registration.

In addition, the functions will enable users of the Insured Portal to perform a series of procedures in relation to insurance products in which they are named as policyholder, insured and/or beneficiary.

For what purposes will we process your personal data?

Who can access the Insured Portal as a user?

The Policyholder, Insured and Beneficiaries of contracted insurance products can register as users of the Insured Portal. If they provide personal data about their age, they expressly authorise the processing of that data, including, if applicable, data about their health to enable the contracted services to be delivered.

What is the lawful basis for data processing?

Confirmation as a registered user of the Insured Portal is based on prior consent and on the existence of an insurance product contracted with Agrupación Sanitaria Seguros, either as policyholder, insured or beneficiary of the product.

All the activity that customers can carry out inside the Insured Portal is justified by the existence of contractual relationship, for its development, execution, control and monitoring.

How long will your data be stored?

The personal data provided will be stored for the fixed period based on the following criteria:

Your data, including on health and claims related to Policies, may be reported by Agrupación Sanitaria Seguros S.A. exclusively for the purposes indicated above, to other insurance, reinsurance, insurance mediation and financial organisations; to relevant public administrations; to medical centres, health centres, hospitals or other institutions or individuals, for the sole purpose of complying with, developing, controlling and executing medical services, making reimbursements or compensation payments and requesting or verifying the causes for these benefits, reimbursements or compensation payments and the Insured’s medical history with these healthcare providers.

Will we send messages by electronic means?

They will only be done to process your request, if it is one of the contact methods you provided.

If we send you commercial communications, they will have been previously and expressly authorised by you.

What are your rights?

If you modify any information, please tell us so we can keep it updated.

Do you want an Exercise of Rights form?

We have forms to enable you to exercise your rights, request them by email or if you prefer, you can use the forms produced by the Spanish Data Protection Agency or by other organisations.

These forms must be electronically signed or accompanied by a photocopy of the identity document.

If someone represents you, you must attach a copy of their ID document or they must sign it with their electronic signature.

The forms may be presented in person, sent by letter or by mail to the address of Agrupación Sanitaria Seguros S.A.

What security measures do we have in place?

We have adopted an optimal level of protection for the Personal Data we handle and we have installed all the technical means and measures at our disposal according to the state of the art, to prevent the loss, wrongful use, alteration, unauthorised access and theft of personal data.

In this sense, access to the Insured Portal and any activity and operation you perform on the same is encrypted through security protocols that apply data protection 256-bit AES encryption, which ensures that data may not be intercepted by third parties.

REGLAMENTO PARA LA DEFENSA DEL ASEGURADO DE ASSSA

Este reglamento tiene por objeto regular el funcionamiento del Servicio de Atención al Cliente y del Defensor del Asegurado de ASSSA, así como las relaciones entre ambos. Se rige por la Ley 44/2002 de 22 de noviembre, de Medidas de Reforma del Sistema Financiero y por la Orden ECO 734/2004, de 11 de marzo, sobre los departamentos y servicios de atención al cliente de las entidades financieras.
